Your Canada application has gone quiet.

No refusal. No request for documents. Just a status page that has not changed in months. Silence from IRCC is not the same as bad news — but it is not nothing either, and there is more you can do about it than most people realise.

First, the thing almost every agent still gets wrong

You have probably been told that you cannot request your own Canadian file from India — that it has to go through a Canadian citizen or permanent resident acting on your behalf. That has been out of date since 13 July 2022.

Privacy Act Extension Order No. 3 extended the right of access under subsection 12(1) of the Privacy Act to all individuals outside Canada. IRCC states it plainly: Canadian citizens, permanent residents and foreign nationals, regardless of where they are located, can request their own personal information. There is no government fee on the Privacy Act route.

The older Access to Information Act route is restricted to citizens, permanent residents and people present in Canada, and it does carry a $5 fee — which is where the confusion comes from. But it is the wrong vehicle for your own personal file.

What this means for you: nobody can tell you that you are legally locked out of your own file. You can do this yourself. People use us because the request has to be lodged correctly the first time, chased when IRCC runs past its deadline, and — the part that actually decides whether it was worth it — read properly when it comes back.

IRCC's processing-times tool is the only figure that matters, and it changes constantly. A file inside the posted window is not stuck — it is queued. Confirm you are actually outside the estimate before spending money on anything.

IRCC's own web form is the official channel for asking about a specific file. It is free, and most applicants either never use it or write it so vaguely that it is closed with a template reply.

Members of Parliament run constituency casework and have a dedicated line into IRCC. Their staff cannot change a decision, but they can ask a question you cannot ask yourself.

This is the rung that tells you which of the others is worth climbing. Your GCMS notes show what has actually happened on the file, when it last moved, and whether anyone is waiting on something from you.

Where delay is genuinely unreasonable, the Federal Court can be asked to order IRCC to decide. This is a lawyer's job, not ours — we are a licensed consultancy, not a law firm, and we refer clients to Canadian immigration lawyers we work with.

What your notes show on a file that has not been decided

GCMS notes are not only for refusals. On a pending application they are a dated record of what has happened so far, and that usually answers the question keeping you awake:

  • When the file last actually moved — not when you last checked, but when an officer last touched it.
  • Whether anyone is waiting on you. Requests go to dead email addresses more often than you would think. A missed letter looks identical to a slow queue from your side.
  • Whether background or security screening is open — which explains a long wait that no web form will speed up.
  • Whether medicals or biometrics have gone stale while everyone waited.
  • Which office holds the file, which sometimes explains everything on its own.

What they will not give you is a decision date. IRCC does not record one, and published processing times are estimates rather than promises. Anyone who tells you otherwise is guessing.

Can I request my own GCMS notes from India while my application is still pending?

Yes. Since Privacy Act Extension Order No. 3 came into force on 13 July 2022, foreign nationals can request their own personal information held by IRCC regardless of where they are located, and the Privacy Act route carries no government fee. The notes exist whether or not a decision has been made.

Do I need a Canadian citizen or permanent resident to file it for me?

Not for your own file. That restriction belongs to the Access to Information Act, which is limited to citizens, permanent residents and people present in Canada and carries a $5 fee. Your own personal information is requested under the Privacy Act, which has neither restriction.

Do GCMS notes tell me when my application will be decided?

No. IRCC does not record a decision date, and published processing times are estimates rather than commitments. What the notes show is what has already happened, when the file last moved, and whether IRCC is waiting on something from you.

How long does an IRCC Privacy Act request take?

Section 14 of the Privacy Act sets a 30-day response deadline. Section 15 lets IRCC extend that with written notice. If the deadline passes you can complain to the Office of the Privacy Commissioner.

Will requesting my file annoy IRCC or slow my application down?

No. Access to your own personal information is a statutory right exercised separately from the application. Requests are handled by IRCC's ATIP unit, not by the officer assessing your case.

Can a Canadian MP's office change the decision on my file?

No. Constituency staff have a dedicated channel into IRCC and can ask questions on your behalf, but they hold no decision-making authority over an application.

Waiting is exhausting because it gives you nothing to act on.

A dated file record ends that. Once you can see where your application actually sits, the decision in front of you becomes a small, concrete one — wait properly, fix something specific, or escalate. Most people find their file is not stuck for any dramatic reason at all.
